Looking to convert your C4 HMO (up to 6 occupants) into a larger sui generis HMO (7+ occupants)? Or increase the size of your large HMO without hte hassle of a formal Full Planning application?

We will share with you examples of successful Lawful Development Certifcate applications for 7-bed, 8-bed, 10-bed and even 11-bed HMO’s

The smartest route is not full planning permission — it’s applying for a Lawful Development Certificate (LDC).

Why?
Most full planning applications for sui generis use are rejected due to:

❌ Neighbour objections - Residents often oppose HMOs due to fears of Anti-social behaviour, Noise and disturbance etc.

❌ Parking Issues - Lack of parking is one of the most common grounds for refusal.

❌ Overconcentration / "HMO Saturation" - Many councils have policies limiting the number of HMOs in a given area.

❌ Impact on Character of Area - Councils reject on "amenity" grounds, claiming that large HMOs change the character of family neighbourhoods

❌ Room Sizes & Amenities - Strict minimum room sizes, shared facilities standards, and amenity space (e.g. bins, bike storage) are often hard to comply with.

❌ Article 4 Direction - Many councils use Article 4 to remove permitted development rights for HMOs. This means any HMO — even a C3 to C4 conversion — requires full planning, and most sui generis applications are treated even more harshly.

❌ Lack of Supporting Evidence - full planning applications require more reports, such as traffic or noise assessments, a solid planning statement. Applications often get refused on technical grounds.

But an LDC avoids almost all of this. It’s a legal confirmation that your HMO use for additional occupants/bedrooms is permitted under planning law — and not subject to public consultation or policy interpretation.

With an approved sui generis LDC:

  • You can legally increase occupancy, generating £1,000s in extra monthly rent

  • You can unlock £100,000s in unrealised equity, as lenders revalue higher income properties with sui generis LDC use confirmed.

Important: Most planning authorities will refuse LDC applications if not submitted correctly. You need to know exactly how to complete the application and, more importantly, what supporting evidence to include.
